Beach Volleyball Courts, Class bookings for Kids and adults

1.  General Conditions - application
   1.1 Any service offered by Esperia Volleyball Academy shall be subject to the terms and conditions of this Agreement, including but not limited to courts rental (standard and long-term), classes (single sessions and packages), camps, events, and tournaments.
   1.2 This Agreement supersedes any previous agreement (and constitutes the entire agreement between the parties) and may only be varied by a written document signed by a duly authorized officer of Esperia Volleyball Academy. 
   1.3 The Esperia Volleyball Academy booking rates are in most cases clearly mentioned on the website https://www.volley.ae and for sports courts rental also on https://esperiavolleyball.skedda.com/. Some ad hoc quotation and pricing strategies might be applied at the sole discretion of Esperia Volleyball Academy management from time to time, and in those cases, the rates are confidential and shall not be discussed with any third party
    

2. Booking and Payments
   2.1 The Client is required to make payment before the commencement of the booking via our online booking system.
   2.2 Standard court rentals must be booked and paid for through the official pages: https://www.volley.ae/rent-and-play or https://esperiavolleyball.skedda.com/. 

• Walk-in clients can pay by cash or card at the venue office before the scheduled start time. 

• Bookings may only be made through the official online booking system and not through chats, phone calls, or any other unauthorized channel. 

• Sub-renting of courts at increased rates and hosting commercial activities or events is strictly prohibited unless approved in advance by Esperia Volleyball Academy and/or relevant authorities. 

• Additionally, displaying banners or signage featuring third-party logos is not permitted without prior approval from Esperia Volleyball Academy. 

• Bookings can be made up to 96 hours in advance of the desired playtime, and rescheduling is allowed with at least 12 hours notice by sending an email to fly@volley.ae. No exceptions will be made to this rescheduling policy. 

• In the event of inclement weather, clients are responsible for monitoring the forecast and may request to reschedule with at least 12 hours notice. 

• The rescheduled session must take place within 3 months of the canceled booking. Refunds will not be provided under any circumstances. 

• Each group is limited to booking a maximum of 2 hours per day. Clients are urged to comply with this policy and refrain from attempting to secure additional hours through the use of multiple accounts, as doing so may result in the immediate cancellation of the booking. 

• Music may be played during sessions, but players are expected to respect neighboring courts by accommodating requests to lower the volume when necessary for communication or personal music playing. 

• Please be aware of UAE laws about obtaining contact details from chat groups and sending unauthorized commercial messages to other players.

 

2.3 For long-term court bookings, rental fees may vary from standard rates and will be detailed in a separate contract between Esperia Volleyball Academy and the Client.

•  Long-term contracts are required to be a minimum of 6 months, with full payment due in advance via cash, cheques, card by POS or link, or bank transfer. 

• For payments made by cheque, a AED 250 administrative fee will be charged for each bounced, dishonored, or unprocessed cheque, in addition to standard UAE financial regulations. 

• Clients are expected to adhere to the schedule outlined in the contract and provide advance notice in case of rescheduling. 

• Sub-renting of courts at increased rates and hosting commercial activities or events is not allowed without prior approval from Esperia Volleyball Academy and/or relevant authorities. 

• Displaying banners or signage with third-party logos requires prior approval. 

• Clients may request to reschedule long-term bookings with 12 hours notice by sending an email to fly@volley.ae. 

• In the event of bad weather, clients must monitor the forecast and may request to reschedule with at least 12 hours notice. 

• The rescheduled session must occur within the duration of the contract. Refunds will not be issued for long-term bookings. 

• Each group is limited to booking a maximum of 2 hours per day for long-term rentals to prevent abuse of the booking system. Attempting to secure additional hours using multiple accounts for the same group may result in immediate booking termination.

 

• 2.4 Regarding the class booking for adult clients, the payments shall be done before the class by card (POS or link) or through the website https://www.volley.ae. After paying, the client shall access his private member area on the same website (https://www.volley.ae) to book the session 96 hours before. On the same page, the client shall also re-schedule or cancel the session with 6 hours of notice, if needed. In case of a cancellation decided by Esperia Volleyball Academy, the session will be credited back to the client profile. The sessions shall be completed within the relevant timeframe (depending on the package) and in any case within 6 months from the purchase date. 
  Clause: Package Freeze Policy.
  Beach Volleyball students enrolled in active packages of 8, 12, 16, or 24 sessions are eligible to freeze their package once per calendar year for a maximum duration of three months. Students with 4-session packages are not eligible for standard freeze options. In the case of injury, all students, including those with 4-session packages, may request a freeze for a longer period or more than once per year. A valid medical certificate must be provided to approve the request. All freeze requests must be submitted in advance and are subject to approval by Esperia Volleyball Academy.

 

• 2.5 Regarding the class booking for minors, the payments shall be done by the parents or guardians before the class by card (POS or link) or through the website https://www.volley.ae. The Parent/Guardian shall also accept the terms and conditions by filling in the form on the following page (https://www.volley.ae/registration). The sessions shall be completed within the relevant timeframe (depending on the package) and in any case within 6 months from the purchase date.

  • In the case of discounted packages (including but not limited to early bird, sibling discounts, etc.) reimbursement is always not allowed.

  • Reimbursements are permitted only in the event of injuries (medical certificate copy to be provided) or force majeure situations. The reimbursement amount will be calculated as the total paid by the client, with a deduction of 20% to cover all expenses already incurred by Esperia Volleyball Academy.

  • Make-up lessons in the same term in other locations and or timing are always available after coach/admin permission. 

  • Make-up lessons in the following term or outside the agreed schedule are ONLY available at the discretion of Esperia Volleyball Academy management and will be considered under the following circumstances:

    1. Session canceled due to unforeseen circumstances e.g., coach illness, facility repairs/unavailability.

    2. Session canceled due to national holidays or unexpected school closures.

    3. Absence for three consecutive sessions or more accompanied by a doctor’s note.
       
       Make-up lessons will not be granted for any other reason. This includes, but is not restricted to, family holidays, single absences, school exams, or clashes with other activities.

• 2.6 The Client that is booking a service on behalf of a group of people shall make sure that all the people are registered on Esperia Volleyball Academy Website (https://www.volley.ae/account/my-bookings) or on Skedda application (https://esperiavolleyball.skedda.com/) in order for them to accept the terms and conditions. In case those people have not registered before the booking, the client shall be the sole responsible in case of damages to the items inside the venue produced by the people in his group (including but not limited to the sand, the fence, the banners, the poles, and anything else available on site).
   

• 2.7 The Client shall comply with all current management and administrative requirements relating to the sports facility as may be advised by Esperia Volleyball Academy to the Client from time to time.

  1. The client shall enter or exit the facility from the main entrance/exit

  2. The client shall not climb, break, or pull up the fence to enter/exit the facility or to move from one court to the other.

  3. The client shall not leave trash on the floor.

  4. The client shall not smoke in our facilities or next to the entrance.

  5. The client shall not move and adjust lines, nets, and any other items in the court without the approval, support, and supervision of Esperia Volleyball Academy employees

 

• 2.8 The Vouchers and the promo codes have a maximum validity of 3 months.    

 

 

3. Disclaimer

 

The Client will be liable and responsible for any personal injury, accident or death, or any loss or damage to The Esperia Volleyball Academy facility or personal property or vehicles caused by any organizers, participants, spectators, or invitees attending any of the Client’s activities in connection with a booking.  The Client will be responsible for obtaining any insurance in relation to its activities or its guest’s as it deems appropriate.

 

Unless specifically agreed in writing, Esperia Volleyball Academy is not responsible for providing any security, medical assistance or facilities (including any first aid or ambulance services) or any other requirements in connection with any event conducted by the client in connection with a booking. 

                                                                                              

           The Client will be responsible for complying with all official and/or legal requirements in relation to any event conducted

           by the Client in connection with a booking.

           This agreement is exclusive to the Client who may not sublease any terms and conditions to a third party.

 

4. Conditions

 

As a courtesy to other users, all parties must ensure they vacate and leave clean and tidy any pitches, courts and/or facilities on or before the completion of their allocated time.  If parties fail to do so, they will be charged for additional fees.

 

Only those persons authorized in writing by the Client can uplift goods on behalf of the Client.

 

Dogs or other animals are strictly prohibited from The Esperia Volleyball Academy venues at any time.

 

All facility users are required to act responsibly and always respect the venue and other users. Any damage to the venue and/or its equipment, when caused by the Client or their guests, shall be charged to the Client including any replacement of items with new equipment if repair is not acceptable to Esperia Volleyball Academy.

 

Esperia Volleyball Academy reserves the right to refuse admission at any time to any person or group due to unacceptable behavior or refusing to follow rules and conditions operating at The Esperia Volleyball Academy.

 

5 Membership Agreement and Code of Conduct.​

1. I allow my name, image, likeness, and performance to be used by Esperia for promotional and other purposes without further consent.

2. I have personal insurance valid in UAE with coverage for sports injuries.

3. Volleyball can be inherently dangerous. Serious accidents can and do happen which may result in me being injured or even killed. I have read and understood this warning, accept and assume the inherent risks related to playing Volleyball or Beach Volleyball in Esperia Volleyball Academy facilities.

4. I hereby for myself, my heirs, executors, and administrators waive and release all rights and claims against Esperia Volleyball Academy, its officers, employees, agents, volunteers, and supervisors, from all losses, injury, damages, fees and other expenses, arising out of or in connection with participation in this activity.

5. I acknowledge that Esperia Volleyball Academy may also use my personal information for the purposes of providing me with promotional material from third parties. I may advise Esperia Volleyball Academy if I do not wish to receive such material.

6. By registering with Esperia Volleyball Academy I understand and agree that Esperia Volleyball Academy will be taking photos/videos at events and during volleyball/beach volleyball classes/games and may publish them in any format or media or channel without additional permission from me if I am in the photo/video.

7. I declare that I am and must continue to be medically and physically fit and able to participate in any Esperia Volleyball Academy activities. I am not and must not be a danger to myself or to the health and safety of others. I will immediately notify Esperia Volleyball Academy of any change to my fitness and ability to participate. I understand and accept that Esperia will continue to rely upon this declaration as evidence of my fitness and ability to participate.

 

6. Website Terms and Conditions

Your access to and use of the Esperia Volleyball Academy website (“Website”) is subject to the following terms and conditions, in addition to applicable laws and regulations in the United Arab Emirates. By accessing the Website, you agree to these terms and conditions, whether you are a registered user or not. Your browsing and use of the Website mean you have unconditionally accepted these terms and conditions.   

 

Esperia Volleyball Academy reserves the right to amend the terms and conditions of use of this Website and you agree to be bound by these amendments. Please note that other websites and pages linked to this Website may be subject to separate terms and conditions. Please visit the respective websites to view their terms of conditions.

 

6.1 Conduct and Behavior

You agree to access and use the Website for lawful purposes only, and to be fully responsible for your knowledge of and compliance with all laws, regulations, and rules regarding your use of the Website. Just by accessing the Website, you agree not to perform any of the following:

1. Use of the Website for the purpose of committing a crime or encouraging others to engage in any conduct that would lead to committing a crime or involves civil liability

2. Publishing or posting of any unlawful content that includes discrimination, defamation, libel, slander, obscene material, pornographic material, or any other unlawful topic

3. Use of the Website to impersonate other parties or entities

4. Use of the Website to upload any material containing software virus, Trojans, or any other codes, files, or software that may alter, destroy, or stop the functions of the Website, devices, or software belonging to any other person who may access the Website

5. Uploading, entering, emailing, or copying of any material you are not entitled to send under any law or contractual relationship

6. Alteration, destruction, or deletion of any content posted on the Website

7. Disruption or impedance of normal communication channels in any way possible

8. Claiming of a relationship with or representation of any company, association, or organization without being authorized to do the same

9. Posting or sending of any advertisements, unwanted marketing material, or any other form of promotion

10. Posting of any materials which violate or interfere with the Intellectual Property Rights of others

11. Collection or storage of the personal information of others

 

6.2 Login

Some sections of the website are only available to logged users and/or allow users to request support or services online by entering personal information. You hereby agree that any information provided to use such sections is complete and accurate, that you will not log in or attempt to access the Website using the login information of another person, and that you will not adopt a user name that Esperia Volleyball Academy may deem inappropriate.

6.3 Termination of Access to the Website

Esperia Volleyball Academy shall be entitled, in its sole discretion, to terminate or suspend your access to or use of this Website without any prior notice or warning, for any reason whatsoever, including the violation of the terms and conditions or any conduct or behavior which Esperia Volleyball Academy believes to be, in its sole discretion, unlawful or harmful to others.

In the event of termination of use, you will not be allowed to access the Website again, and Esperia Volleyball Academy will use the right to resort to any means possible to implement such termination.

6.4 Indemnification

You agree to indemnify, defend and hold Esperia Volleyball Academy and all of its employees and agents harmless from and against any and all liability, including attorneys' fees and costs, incurred in connection with any claim arising out of any breach by you of these Terms and Conditions.

 

6.5 Limitation of Liability

Under no circumstances whatsoever, Esperia Volleyball Academy shall be liable for any accidental, indirect, special, or punitive damages that may arise as a result of your use or inability to use the Website, including but not limited to the loss of income or expected profits, loss of reputation, loss of business, loss of data, computer malfunction, or any other damages.

 

7. Privacy Policy

 

7.1 Collection and Use of Information

 

Some of the following information is collected anonymously and randomly while users browse the Website or use applications on their smartphones: 

• IP address of the device you used to access the Website, as well as your visit time and date. 

• The pages you visited on the Website 

• Your geographical location when browsing the Website 

The above information is obtained in an aggregate and anonymous manner for the improvement of the Website performance. Such information is not disclosed at all to any other party.

Your personal information will only be made available to Esperia Volleyball Academy employees who need to have access to it. This information will not be made publicly available without your consent. Similarly, no such information will be exchanged, sold, or traded with any third party without your prior consent, and access to that information will only be permitted to qualified individuals and specialists who provide Esperia Volleyball Academy services related to your interactions with our Website.

 

7.2 Information Security Controls 

Esperia Volleyball Academy has implemented the necessary controls to protect the privacy of personal information provided by the user or collected by the Committee.

 

8. Amendments

 

Esperia Volleyball Academy reserves the right to update or amend the Terms and Conditions in this page at any time. The Privacy Policy must be reviewed regularly for any changes.
